This website is operated by Epais™. Throughout the website, the terms “Epais,” “we,” “us,” and “our” refer to Epais™.

Epais™ provides this website, including its information, content, features, tools, products, and services (collectively, the “Services”), to you conditioned upon your acceptance of these Terms of Service.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer and sell our products.

By visiting our website, placing an order, creating an account, subscribing to a product, or otherwise using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, you should not access or use the Services.

1. Eligibility and Account Information

By using the Services, you represent that you are at least the age of majority in your state of residence or that you have permission from a parent or legal guardian.

You agree to provide accurate, current, and complete information when creating an account, placing an order, or otherwise using our Services.

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. Please notify us immediately if you believe your account has been accessed without authorization.

You may not sell, transfer, assign, or license your customer account to another person.

2. Products and Product Information

We make reasonable efforts to describe and display our products accurately. However, product colors, appearance, packaging, and other details may vary slightly depending on your device, screen settings, manufacturing updates, or product availability.

All product descriptions, prices, promotions, images, ingredients, packaging, and availability are subject to change without notice.

We reserve the right to:

Limit the quantity of products available for purchase.

Refuse orders that appear to be placed by resellers, distributors, or unauthorized dealers.

Our products are currently available for purchase and delivery within the United States.

3. Cosmetic and Wellness Disclaimer

Epais™ products are cosmetic and personal-care products. They are not drugs and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Product information provided through our website is intended for general informational purposes and is not a substitute for professional medical advice, diagnosis, or treatment.

Individual experiences and results may vary. We do not guarantee that any customer will achieve a specific cosmetic or hair-care result.

Always review product ingredients and follow the provided directions. If you have a medical condition, use prescription medication, are pregnant or nursing, or have concerns about using a product, consult a qualified healthcare professional before use.

Discontinue use and seek appropriate medical advice if you experience significant irritation, discomfort, or an adverse reaction.

4. Orders and Acceptance

Submitting an order constitutes an offer to purchase products from Epais™. We reserve the right to accept, decline, limit, or cancel an order for any lawful reason.

An order is not considered accepted until payment has been successfully processed and we have sent an order confirmation.

Please review your order, shipping address, products, quantities, and payment information carefully before completing checkout. Once an order enters processing or fulfillment, we may be unable to change or cancel it.

If we cancel or modify an order, we will attempt to notify you using the email address or telephone number provided during checkout. Any applicable refund will be issued to the original payment method.

Products purchased through our website are intended for personal or household use and may not be purchased for unauthorized resale or export.

5. Prices, Payments and Billing

All prices are displayed in U.S. dollars unless otherwise stated.

Product prices, discounts, offers, and promotions may change at any time without notice. The price charged will be the price displayed at checkout when your order is submitted.

Unless expressly stated otherwise, listed product prices do not include applicable taxes, shipping charges, or other fees. Any applicable costs will be displayed during checkout before you complete your purchase.

You represent that:

The payment information you provide is accurate and complete.
You are authorized to use the payment method provided.
Charges submitted using your payment method will be honored.
You will pay all charges associated with your order.

You authorize Epais™, Shopify, and our payment providers to charge your selected payment method for the total amount displayed at checkout.

6. Promotions, Bundles and Free Gifts

Promotions, discount codes, bundles, Buy One, Get One offers, and free gifts may be subject to additional conditions displayed with the offer.

Promotions:

Are available only during the stated promotional period.
Cannot be combined unless expressly permitted.
Have no cash value.
May be modified or discontinued where permitted by law.
May be limited by customer, household, order, or product.

Complimentary products and free gifts cannot be separately exchanged or redeemed for cash.

Returns involving bundles, BOGO offers, or free gifts are governed by our Return and Refund Policy. To receive a full refund, customers may be required to return every product included in the promotional offer.

7. Subscriptions and Automatic Renewals

When you purchase a subscription, you authorize us to automatically charge the payment method associated with your subscription at the frequency and price disclosed at checkout until the subscription is canceled.

Subscription prices, delivery frequency, applicable discounts, and renewal terms will be presented before you complete your purchase.

You are responsible for managing your subscription and ensuring your billing and shipping information remains accurate.

You may cancel your subscription through the subscription-management option provided to you or by contacting us at support@officialepais.com. Cancellation requests must be submitted before the next order is processed.

Canceling a subscription prevents future renewals but does not automatically cancel or refund an order that has already been processed. Processed subscription orders are subject to our Return and Refund Policy.

We will provide any renewal notices required by applicable law.

8. Shipping and Delivery

We currently ship within the United States.

Delivery dates and transit times are estimates and are not guaranteed. Shipping may be delayed by carriers, severe weather, high order volume, incorrect addresses, or other events outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. We are not responsible for delays or failed deliveries caused by incorrect or incomplete information supplied by the customer.

Once an order has shipped, changes to the delivery address may not be possible.

If your tracking information shows an unusual delay, loss, damage, or delivery problem, contact us at support@officialepais.com so we can review the situation.

9. Returns and Refunds

Returns, refunds, damaged products, promotional orders, and related matters are governed by our Return and Refund Policy.

Customers must contact us within the return window and receive authorization before sending a product back. Unauthorized returns may not be accepted.

Original shipping charges and customer-paid return shipping costs are nonrefundable unless otherwise required by law.

10. Intellectual Property

The Services and their content—including our business name, trademarks, logos, product names, photographs, videos, text, graphics, designs, reviews, layout, and other materials—are owned by or licensed to Epais™ and are protected by applicable intellectual-property laws.

You may access and use the Services only for lawful, personal, and noncommercial purposes.

Without our prior written authorization, you may not:

Copy, reproduce, republish, distribute, sell, or commercially exploit our content.
Modify or create derivative works from our content.
Use our photographs, videos, product descriptions, branding, or advertisements.
Remove copyright, trademark, or proprietary notices.
Use our trademarks, name, or branding in a manner that suggests affiliation or endorsement.
Scrape, extract, download, or systematically collect website content.

No license or ownership right is granted to you except the limited right to use the Services in accordance with these Terms.

11. Reviews, Feedback and User Content

If you submit a review, photograph, video, testimonial, suggestion, or other content to us (“User Content”), you grant Epais™ a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, edit, publish, display, distribute, and promote that content in any lawful medium.

You represent that:

You own or have permission to submit the User Content.
Your submission is truthful and reflects your genuine experience.
You have disclosed any compensation, free products, discounts, or incentives received.
Your content does not violate another person’s rights.
Your content is not unlawful, threatening, abusive, defamatory, deceptive, obscene, or malicious.
Your content does not contain malware or harmful code.

We may remove User Content that violates these Terms, but we are not obligated to monitor every submission.

You remain responsible for the accuracy and legality of the content you submit.

12. Third-Party Services and Links

Our Services may include tools, applications, integrations, or links operated by third parties.

We do not control and are not responsible for the content, availability, privacy practices, security, products, or services of third-party websites or platforms.

Your use of a third-party service is subject to that provider’s terms and policies. Review those terms before providing information or completing a transaction.

13. Relationship With Shopify

Epais™ uses Shopify to host and provide portions of the Services. Purchases made through our store are transactions directly between you and Epais™.

Shopify is not the seller of our products and is not responsible for the quality, safety, performance, delivery, return, or use of products purchased from Epais™.

To the extent permitted by law, you release Shopify and its affiliates from claims arising directly from your purchase or use of products sold by Epais™.

Information collected through the Services is handled according to our Privacy Policy and, where applicable, the Shopify Consumer Privacy Policy.

14. Errors and Inaccuracies

Occasionally, information on our website may contain typographical errors, inaccuracies, or omissions concerning product descriptions, ingredients, prices, promotions, availability, shipping charges, or delivery estimates.

We reserve the right to correct errors, update information, or cancel affected orders where permitted by law, including after an order has been submitted.

If an order is canceled after payment, we will refund the applicable amount to the original payment method.

15. Prohibited Uses

You may not use the Services:

For an unlawful, fraudulent, deceptive, or malicious purpose.
To violate any applicable law or regulation.
To infringe our rights or the rights of another person.
To harass, threaten, defame, abuse, discriminate against, or harm another person.
To submit false, inaccurate, or misleading information.

To collect or track another person’s personal information without authorization.

You remain responsible for amounts owed before termination.

Provisions that by their nature should continue after termination—including intellectual property, user content, warranty disclaimers, limitations of liability, indemnification, and governing law—will survive.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and products are provided “as is” and “as available,” except for any express warranties provided by Epais™ or rights that cannot lawfully be excluded.

We do not guarantee that:

The Services will always be uninterrupted, timely, secure, or error-free.
Website information will always be complete or current.
Products will meet every customer’s expectations.
A product will produce a particular cosmetic or hair-care result.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above limitations apply only to the extent permitted by law.

Nothing in these Terms limits any nonwaivable consumer rights available under applicable law.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Epais™, its affiliates, officers, employees, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of the Services or products.

This includes, without limitation, lost profits, lost revenue, loss of data, lost savings, business interruption, or replacement costs, whether the claim is based in contract, negligence, strict liability, or another legal theory.

Where liability cannot legally be excluded, our liability will be limited to the maximum extent permitted by law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Epais™, Shopify, and our respective affiliates, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable legal expenses arising from:

Your material violation of these Terms.
Your unlawful use of the Services.
Your infringement of another person’s rights.
User Content submitted by you.

This obligation does not apply to the extent a claim results from our own unlawful conduct, negligence, or willful misconduct.

20. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed if necessary.

The remaining provisions will continue in effect.

21. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

A waiver will be effective only if made in writing by an authorized representative of Epais™.

22. Entire Agreement

These Terms and the policies incorporated by reference constitute the entire agreement between you and Epais™ concerning your use of the Services.

They replace prior or contemporaneous communications and agreements concerning the same subject matter.

23. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign these Terms in connection with a merger, acquisition, restructuring, financing, sale of assets, or transfer of our business, subject to applicable law.

24. Governing Law

These Terms and any dispute relating to the Services will be governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Subject to applicable consumer-protection laws, any legal proceeding relating to these Terms or the Services will be brought in the state or federal courts serving Adams County, Colorado. You and Epais™ consent to the jurisdiction of those courts.

25. Changes to These Terms

We may update these Terms periodically to reflect changes to our Services, practices, or legal obligations.

The current version will be posted on this page with an updated revision date. Material changes will be communicated where required by law.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
